This area is dedicated to inform
and explain how ODOT's planned bypass project DOES NOT
CONFORM with the description and requirements of Clinton
County's agreement (by commissioners) to cooperate, consent to, and
allow ODOT to construct the highway project.
On September 21, 2005, your commissioners,
acting in your behalf, officially enacted that agreement with
the state Director of Transportation (Gordon Proctor, ODOT).
The resolution is documented in the commissioner's public record log
as "Resolution #05-1036, By: Riley and
Curry".
The resolution reads (in part) as
follows:
SECTION I --- Project
Description
WHEREAS, the COUNTY/STATE has identified the
need for the described project:
Existing SR 73, which currently runs through the
City of Wilmington, will be relocated along a new alignment
approximately one (1) mile north of Wilmington's central business
district. This will reduce delay and congestion which in turn
will improve traffic safety on SR 73 and US 22/SR 3 in the City of
Wilmington. The approximate length of the project is 6.75
miles. The proposed roadway design will consist of four
12-foot lanes, grade separated access
points, paved shoulders, and open
ditches.
SECTION II -- Consent
Statement
Being in the public interest, the LPA (Local
Public Agency [Clinton Co.]) gives consent to the Director of
Transportation to complete the above described project.

ODOT's actual
plans for the bypass project agree witht
he "Project Description" (above) excepting
the "grade separated access
points" wording. ODOT's bypass
plans account for and detail four (4) access points to the
new build section of SR 73. Those four (4) access points
are listed below including the specific design type at the given
access point.
1. (near the SR 73 West terminus pt.)
Bypass access point, or intersection with existing Mitchell Rd. is
designed as an "AT GRADE access
point".
2. (at existing US 68 North) Bypass access
point, or intersection with existing US 68 is designed as a
"GRADE SEPARATED access
point".
3. (at existing US 22 / SR 3 East) Bypass
access point, or intersection with existing US 22 / SR
3 is designed as a "GRADE SEPARATED access
point".
4. (near the SR 73 East
(south) terminus pt.) Bypass access point, or
intersection with existing Airborne Rd. is designed as an
"AT GRADE access point".
Since only two (2) of four (4) access points to
the new build section of SR 73 (bypass) conform with
YOUR / OUR (Clinton County)
agreement with the state Director of Transportation for construction
of the project, is that not a BREACH of CONTRACT /
AGREEMENT? And, is that not illegal?
The only reasonable intent and purpose for our
elected officials, commisioners and prosecutor, in their actions
(resolution here) is "being in the public
interest". That exact wording is included in the
resolution as noted above. Since the ODOT project, as
planned, VIOLATES the commissioner's (Clinton
County's) agreement, the bypass project IS
NOT in the public interest nor
in the INTEREST OF CLINTON
COUNTY.
Why do laws, contracts, agreements, resolutions,
regulations, etc. exist? Will your/our Clinton County elected
officials appropriately and effectively represent you/us regarding
illegal activity against the people, residents, and taxpayers
of Clinton County (esp. Union township)?
Continuing below -- further detailed data,
information and detail maps for the two (2) bypass access points
that VIOLATE the county / ODOT
agreement.

(background info) -- Our
commissioners officially agreed with the Ohio Dept of Transportation
to proceed with the construction of the bypass (dated Sept 21,
2005). The bypass description in that agreement stated that
all access points to the new highway would be GRADE
SEPARATED . That means that where the bypass intersects
with another road and the secondary road is to have access to
either enter or exit the bypass, either the bypass or
the secondary road must pass over or under the other (different
level) WITH ramps providing the access between the two. ODOT's
plans for the bypass DO NOT meet the requirements of the
commissioner's agreement at the 'new build' intersections with
Mitchell Rd. and Airborne Rd. NOTE: the typical interstate
type interchange, with overpass and enter / exit access
ramps is a GRADE SEPARATED access point to the given
interstate highway. Two (2) roads or highways that intersect
on the same level (or grade) and require either stop signs or stop
lights for traffic control is an AT GRADE access point
to a given highway (road).

PROBLEM:
At the east end (Airborne Rd.) the new build highway will
connect to existing SR 73 about 1900 ft (.36 mile) south of Airborne
Rd. Existing Airborne Rd. will be extended east to intersect
w/ the new build bypass. That intersection with Airborne
Rd. WILL NOT BE a "GRADE SEPARATED ACCESS" to the new
build bypass. NOTE: the extended Airborne Rd. intersection w/
the new build bypass will be something like 750 - 900 ft. east of
the existing SR 73 / Airborne Rd. intersection. See detail
"Map #6" and ODOT's detail drawing "#D1"
(below).
The existing SR 73 / Airborne
Rd intersection is overly dangerous with repeated accidents
involving heavy interstate trucks. The new bypass intersection
there DOES NOT improve that condition, it only duplicates the
existing intersection arrangement -- only adding two (2) more lanes
(and more speed) to SR 73. Keeping in mind the whole purpose
of the bypass project is to take trucks around downtown Wilmington
for safe easy access to DHL (Airborne Rd.). How does
duplicating an existing dangerous intersection -- make it even more
dangerous -- accomplish that
purpose?

PROBLEM: Near the
western terminus of the new build bypass project, the new build
bypass will intersect with existing Mitchell Rd. before the bypass
reconnects with existing SR 73. That intersection with
Mitchell Rd. WILL NOT BE a "GRADE SEPARATED ACCESS" to
the new build bypass. ODOT has not yet defined (final) the
type of traffic control to be installed at the Mitchell Rd.
intersection. The most recent info (from
ODOT) indicates there will be a flashing RED light
on Mitchell and a flashing YELLOW light on the new build
bypass. Bottom-line -- the current plan for the bypass project
DOES NOT agree with the commissioner's resolution
(description). See detail "Map #7" and ODOT's detail drawing
"#D2" (below).
